Ноя 28.2022

The opening ceremony of the XVI International Festival of Documentary Films on Human Rights "Bir Duino-Kyrgyzstan 2022" was held on 14 November 2022, in Bishkek at "Bellagio Premium", Avangard Business Center, from 6 to 9 p.m.

Representatives of government services, international and national
experts, representatives of embassies and international organizations, as well as filmmakers and civic activists took part in the ceremony. This year the festival was held under the slogan "Climate and Crises: the Situation with the Fundamental Rights of Citizens, Alternatives for the SDGs".

"The key topic is human rights in times of crises and disasters, because during such a period of trials it is important to find alternative strategies to promote Sustainable Development Goals. This is possible only if human rights and freedoms are respected and citizens participate equally in the decision-making process at all levels of government."

The program of the festival opening ceremony was focused on the events that took place in Ukraine, via screening of the animated documentary "We Have Left. Voices of Ukrainian Children" created by ADC "Memorial". The animated documentary is based on interviews conducted by psychologists with Ukrainian children forced to migrate to the EU countries because of the war. The children describe their feelings when they realised that the war broke out, how they survived shelling, evacuation, separation from loved ones; they talk about their pain, hopes and dreams. https://www.youtube.com/watch?v=4muybK7QSgQ

During the opening ceremony, the festival organizers were informed that human rights activist Vitaly Ponomarev, Memorial Human Rights Center, who was awarded the Nobel Peace Prize (2022), was deported from Manas Airport to Moscow on the basis of an entry ban imposed by the SCNS for a period until 27 June 2022. The ban period expired a few months ago. However, the ban, contrary to the law, remains in effect, which led to the illegal deportation of Vitaly Ponomarev on 14 November 2022. Both the Border Service and the leadership of the SCNS were informed about this situation in advance. The Norwegian Helsinki Committee has lodged a complaint with the UN Special Rapporteur on Human Rights Defenders concerning the deportation of Vitaly Ponomarev from Bishkek on 14 November 2022.

The format of the festival "Bir Duino - 2022" is an exchange of best practices in overcoming various crises. International partners of the festival and experts, such as Elina Steinerte, elected member of the UN Subcommittee on Prevention of Torture (2023-2026), former Chairperson-Rapporteur, member of the Working Group on Arbitrary Detention (2016-2022), shared their experience in this regard. Uransuzh Gambasuren, human rights defender from Mongolia, shared her experience on the new Law on Protection of the Rights of Human Rights Defenders of Mongolia. Andreas Roksen, Swedish journalist, director and producer, Ksenia Shimanskaya, director of the Human rights Department of the international festival "Docudays UA" (Ukraine) shared their knowledge on promotion of human rights through art and new innovative strategies.

Master classes and laboratories were held in thematic blocks for discussion of issues of climate security, civil and political rights, social, economic and cultural rights, the role of local citizens in decision-making processes at all levels of government, the activities of human rights defenders during crises and disasters, the fight against impunity, children's rights, gender equality and non-discrimination.

The International Festival of Documentary Films on Human Rights "Bir Duino-Kyrgyzstan 2022" is the only human rights festival in Central Asia that provides a broad platform for viewing and discussing documentary truth in the human rights field, attracting filmmakers from near and far abroad.

The festival screenings, which took place from 15 to 18 November at the Broadway cinema in Asia Mall, were attended by hundreds of spectators from among representatives of state, international and non-governmental organizations, residents and guests of the capital. A platform for discussing the films was organized, and everyone, regardless of their national and social background, age and religion, was given the opportunity to get involved in a discussion about justice and corruption, good governance, the rights and duties of the citizens.

The program of the Festival-2022 presented to the viewers the brightest documentaries, released mainly in 2022 and presented by authors from France, Germany, Estonia, Czech Republic, Kazakhstan, Ukraine and Kyrgyzstan. The competition program of the festival included 22 documentaries: 16 local and 6 foreign ones.

On the first day of the festival, nine films about gender equality and climate change were shown. They were viewed by more than 300 people.

On 15 November 2022, at about 4 p.m., Tursuniyaz Dosaliev and Dzholdoshbek Kyrgyzbaev, employees of the Kyrgyz Tasmasy State Institution under the Ministry of Culture, Information, Sports and Youth Policy of Kyrgyzstan, approached the organizers of the festival. They announced a ban on the screening of the films "Mara" (60 minutes, directed by Sasha Kulak, 2022, France, Great Britain) and "This Rain Will Never Stop" (103 minutes, directed by Alina Gorlova, 2020, Ukraine, Germany, Latvia, Qatar).

On 16 November 2022, in the morning, Samat Begaliev, commercial director of the Broadway cinema, forbade the projectionist to start screening of the films in the cinema hall. He presented a letter of the State Institution "Kyrgyz Tasmasy" dated 16 November, 2022 on the suspension of the screening of documentaries at the Broadway cinema as part of the festival. The justification of the refusal was the Resolutions of the Government of the Kyrgyz Republic No. 550 dd 29 October, 1999 and No. 551 dd 14 October, 2018. The letter was signed by the head of the film distribution department P.A. Borpieva. As a result, the screenings of the films "Mara" and "This Rain Will Never Stop" were canceled, as the documentaries had not undergone state registration.

According to Part 2 of Article 10 of the Constitution, censorship is not allowed in the Kyrgyz Republic. The Human Rights Movement "Bir Duino Kyrgyzstan" declares the unacceptability of the categorical restriction of human rights and freedoms in violation of Articles 10, 23, 33, 55 of the Constitution of the Kyrgyz Republic, Articles 2, 19 of the International Covenant on Civil and Political Rights, Articles 6, 12, 13 of the UN Declaration on the Right and Responsibility of Individuals, Groups and Organs of Society to Promote and Protect Universally Recognized Human Rights and Fundamental Freedoms.[1]

Despite the agreement on the lease of the cinema hall dated 13 October 2022, which did not provide for any restrictions and prohibitions on the screening of any films, AIM Group LLC (the cinema) did not inform us on any legal grounds for violating its obligations to show the films "Mara" and "This Rain Will Never Stop".

As a result, the entire program of the festival was shown on 16, 17 and 18 November, and on the evening of 18 November a special screening of the film "This Rain Will Never Stop" was organized at Ololo House.

On 17 November 2022, at 6 p.m. the closing ceremony and awarding of the winners of the festival took place at "Bellagio Premium" at the Avangard Business Center in Bishkek. The winners were awarded in six main categories. Each of the following nominees received unique prizes of the Festival "Bir Duino Kyrgyzstan": a diploma and a statuette of Umai Ene.

SHAKHBOZ LATIPOV

SHAKHBOZ LATIPOV

Experience should be attached to a law degree

Shakhboz Latipov, 24 y.o., young lawyer: “When I came to BDK for an internship, I had no experience in legal and human rights activities. Together with experienced senior colleagues, I began to attend trials, studied documents. Gradually my supervisor Khusanbai Saliev began to trust me the preparation of documents, carefully checked them and gave practical advice. Experience comes with time and cases you work on. Every day dozens of people who need help come to us, many of them are from socially vulnerable groups: the poor, large families, elderly citizens. A lawyer in a human rights organization sometimes acts as a psychologist, it is important for him to be able to maintain professionalism and show empathy. At the end of 2019, I successfully passed the exam to get the right to start working as attorney and now I work on cases as an attorney. I turn to my colleagues for help on complex issues, they always give me their advice. This is one of the strengths of the organization: there is support and understanding here.”

FERUZA AMADALIEVA

FERUZA AMADALIEVA

Organization unites regions

Feruza Amadalieva, social worker, leader, teacher: “TOT from BDK is a great opportunity to get acquainted with participants from different regions, we continue to communicate on social media and when we meet at events, as close friends, we have such warm relations! At the events, I improved my knowledge, systematized it, clarified how to apply it in practice. I really like the training modules and the way the system of training and practice is built: role-playing games, theory, discussions. Each person expresses himself/herself. I have become a leader for other vulnerable women, I try to help them and engage them in such events.” Feruza Amadalieva is a regular participant of many BDK events, she invites the BDK lawyers to provide legal advice to vulnerable women.

NURIZA TALANTBEK KYZY

NURIZA TALANTBEK KYZY

I became confident

In summer of 2019, Nuriza Talantbek kyzy took an active part in conducting regional screenings of documentaries, helped with organizational issues during the campaign dedicated to the International Day in Support of Victims of Torture, participated in trips, and did the TOT on women's leadership. She used to be a migrant, worked for an NGO in Osh, and now works in Bishkek in the service industry. She calls her participation in the TOT “an invaluable experience”: “I first attended such an event, and received exactly the information that I needed, for which I am sincerely grateful to the facilitators. I experienced very difficult issues in my life, and thanks to that knowledge, I was able to overcome them, I persevered! After the TOT, I became more confident, began to better understand the essence of human rights, and learned to defend my interests.”

SHUKURULLO KOCHKAROV

SHUKURULLO KOCHKAROV

The defendant has passed away. The work on his rehabilitation continues.

The case of Shukurullo Kochkarov shows that work on complex cases continues for many years. After the torture he was subjected to in 2010, he became disabled. We managed to get acquittal on one of the charges; the work is ongoing on achieving his rehabilitation and recognition as a victim of torture in order for compensation to be paid. Trials continue without Shukurullo Kochkarov - he died on 2 August 2019. His interests are represented by his father, Saidaziz Kochkarov, who also has a visual disability. “For many years, we have been supported by the employees of BDK, they have been handling the case of my son, they brought him to court because he couldn’t walk on his own, they constantly help our family: my wife and I underwent rehabilitation, they have helped my son by providing him with medicines, they provide all kinds of help”.

DILYOR JUMABAEV

DILYOR JUMABAEV

Comprehensive support for victims of torture

Resident of the Kara-Suu district, Dilyor Jumabaev, has extensive experience in dealing with law enforcement agencies. In 2010, he was accused of possessing firearms, and thanks to the work of lawyers, he was acquitted. Two years later, his house was first searched in order to find materials of an extremist nature, but nothing was found. In 2014, he was accused of possessing extremist materials. In court, the prosecutor requested 15 years in prison; the court sentenced him to 6 years. A few years later he was released on parole. “I am grateful to the lawyers of BDK for their expert legal assistance. I participated in a rehabilitation program for victims of torture. When I encounter violations, I recommend contacting this organization.”
